EMPLOYER ASSURANCES Possible raises, bonuses, or incentives are dependent on tenure with the company, experience, or job performance. WAGES A single workweek will be used to compute wages due. A wage offered equally to the highest of the employer's Prevailing Wage determination. Workers will be paid every two weeks. The employer will make all deductions from the worker's paycheck required by law. Employer-Provided Items The employer will provide workers with all tools, supplies, and equipment required to perform the job at no charge to the worker. Three-Fourths Guarantee Period of Employment is 120 days or more The employer guarantees to offer work for hours equal to at least ¾ of the workdays in each 12-week period of the total employment period. First Workweek Guarantee H-2B workers will be reimbursed in the first workweek for all visa, visa processing, border crossing, and other related fees, including those mandated by the government (excluding passport fees). Transportation and Subsistence Benefits Transportation and Subsistence Benefits. Transportation (including meals and, to the extent necessary, lodging) from the place from which the worker has come to work for the employer, whether in the U.S. or abroad, to the place of employment will be provided, or its cost to workers will be reimbursed, in full, and subsistence expenses will be reimbursed at $16.28 per day minimum without a receipt to a maximum of $68.00 per day with receipts when the worker completes half the employment period. Return transportation to the place from which the worker came to work for the employer will be provided if the worker completes the employment period or is dismissed early by the employer. Daily Transportation (Optional): Does not apply (one location only). Disclosure of Job Order: The employer will provide the H 2B worker outside of the U.S., no later than the time at which the worker applies for the visa, or to a worker in corresponding employment, no later than on the day work commences, a copy of the job order, including any subsequent approved modifications. For an H 2B worker changing employment from an H2B employer to a subsequent H 2B employer, the copy will be provided no later than the time an offer of employment is made by the subsequent H 2B employer. The disclosure of all documents required will be provided in a language understood by the worker, as necessary or reasonable. Notice of Worker Rights The employer will post and maintain in a conspicuous location at the place of employment a poster provided by the Department of Labor that sets out the rights and protections for H 2B workers and workers in corresponding employment. The employer will post the poster in English. To the extent necessary, the employer will request and post additional posters, as made available by the Department of Labor, in any language common to a significant portion of the workers if they are not fluent in English. Other Transportation and subsistence benefits (continued from above): The employer will reimburse and/or pay workers for transportation and subsistence benefits by separate employer's check. Inbound and Outbound transportation includes subsistence expenses. The employer will provide workers at no charge with all tools, supplies, and equipment required to perform the job.
