About the Role
The Privacy Counsel is responsible for providing proactive leadership, direction, guidance, and support to business divisions, strategic business units and corporate functions in all aspects of data privacy. The Privacy Counsel will assist in leading the ongoing implementation, coordination, and management of a comprehensive privacy program to meet state, federal and global laws and regulations related to data privacy. The Privacy Counsel also will also cultivate and leverage robust enterprise-wide collaborations. The Privacy Counsel will be a valued global partner and advisor to several corporate functions, including, but not limited to IT, HR, and Marketing by providing strategic consultation, independent assurance, and a catalyst for coordinated, balanced action on risk and compliance matters. The position will report to the Director of Privacy.
What You Will Do
Manage Data Privacy Risks
Identifying data privacy and security issues in product initiatives and customer agreements, and working cross-functionally with the appropriate teams to create solutions and minimize risk.
Engaging strategically in risk assessment/mitigation and developing innovative approaches to data privacy and security issues in support of business objectives.
Identify and develop initiatives to prevent, detect, and respond to internal and external data privacy risks through the continuous development and evolution of a comprehensive data privacy program, policies and procedures, annual oversight and monitoring plans, and privacy education and awareness-building.
Bring a systematic, disciplined approach to evaluate and improve the effectiveness of risk management, controls, and governance processes.
Establish and maintain practices to protect personal information and HARMAN's confidential information in a manner consistent with HARMAN's values and applicable laws and regulations.
Anticipate and address data privacy issues as they arise, respond to internal and external inquiries, concerns, and complaints, and prepare formal responses.
Adherence to privacy laws and regulation.
Stay current and drive proactive action in the dynamic regulatory environment.
Oversee and monitor HARMAN's compliance with applicable state, federal, and global laws, and with HARMAN policies and procedures, and privacy standards.
Conduct training to increase awareness and proficiency around data privacy issues to reduce risk and incidents.
Protect the integrity of data collected, created, transmitted, released, and stored by HARMAN entities and affiliates.
Investigation and response to privacy incidents
Working closely with HARMAN's information technology and cybersecurity teams, lead complex investigations into privacy-related allegations and incidents, conduct interviews as needed, and follow incidents to resolution in accordance with regulatory reporting or contractual deadlines.
Take a lead role in preparing formal responses to external state, federal or global investigative bodies; recommend corrective action plans and subsequent monitoring plans to management.
Steward operational controls so that data privacy program components and activities meet state, federal, and international privacy laws.
Work closely with HARMAN's information technology and other data security and privacy leaders across HARMAN to coordinate policies and procedures, incident response, best practices, and messaging relative to data privacy.
What You Need to Be Successful
The candidate should have Juris Doctor and Bar admission (or equivalent in jurisdiction).
3-5 years of relevant (generally in-house or law firm) experience with increasing responsibility in leading data privacy programs.
Success operationalizing a privacy program is desired.
Track record of active and appropriate responses to privacy violation allegations, incidents, and investigations, including working with stakeholders.
Demonstrated success in educating a range of stakeholders on a comprehensive privacy plan.
Experience communicating with oversight bodies and committees
Subject Matter Knowledge
Expert knowledge of state, federal and global privacy statutes, laws and regulations, industry standards, trends, and regulatory requirements. Working knowledge of industry-accepted privacy and security frameworks.
Ability to understand, research, analyze, interpret, and apply complex U.S. and global privacy laws, rules, regulations, and guidelines and constantly changing risk profiles and evolution.
Thorough understanding of industry best practices in privacy and demonstrated success in strategic planning, program evaluation, and improvement to create and implement a vision for privacy operations.
Understanding of "privacy by design" practices and privacy engineering; appreciation for the complexity of how information flows.
Operational Effectiveness and Efficiency
Effectively prioritizes, delegates, supervises, and monitors work carried out by external legal resources or non-legal project teams to ensure high quality and timely delivery.
Identifies potential legal and compliance issues and consults with appropriate stakeholders to identify a solution.
Takes initiative to develop or improve internal company guidance documents, using legal know-how for the benefit of the entire business or function.
Influencing and Communicating
Highly effective written, oral, and interpersonal communication skills to address a variety of sophisticated audiences.
Proven presentation experience and comfort with senior leadership audiences. Effective facilitation skills with diverse groups.
