Description:
This position, in accordance with laws, court rules, and court policies and procedures, will review and make determinations about time sensitive filings (submitted via fax, email, mail), qualify fiduciaries, and make appropriate entries into the case management/document management system on a real-time basis. This position must quickly review and scrutinize filings for accuracy and completeness prior to acceptance and filing.
Duties and Responsibilities:
The following information contains general duties of the position and is not all inclusive. Job responsibilities are subject to assignment by Management.
• Demonstrate a working knowledge of laws and court rules as they pertain to processing petitions and filings in the Wayne County Probate Court, including high level knowledge to immediately discern time sensitive materials related to upcoming hearings.
• Knowledge of and ability to apply appropriately the Estates and Protected Individuals Code (EPIC), Michigan Court Rules, Mental Health Code and court procedures, legal terminology, and Court paper flow to accomplish departmental job responsibilities.
• Demonstrate the ability to process information quickly for time sensitive routing requirements.
• Review and scrutinize filings for accuracy and completeness prior to acceptance and filing, review the case management system to determine if the filings relate to upcoming hearings, document hearing dates as needed.
• Enter or distribute all filings submitted to courtrooms, which include, but are not limited to:
o Waivers and Stipulations, Deferral Agreements, Requests for IMEs, Withdrawn/Voluntary Admission, Discharges, Certificate of Legal Counsel, Request to Defer, and related documents according to BHU policies and procedures.
o Bonds and rider bonds
o Acceptance of Appointments, confidential filings, annual reports with death certificates, miscellaneous filings, death certificates related to guardianships
o Objections, briefs, responses, replies, answers
o Proposed orders submitted for consideration by the Court
o GAL reports
o Receipts
o Substitution of Attorneys, Appearance of Attorney
o All filings and petitions related to Sealed Documents
o Other filings submitted directly to courtrooms
o Contact Information, Protected Personal Identifying Information when included with applicable filing
• Accurately and timely enter data into the document management system/case management system using specific computer codes, and manually indexing documents when applicable.
• Qualify fiduciaries with the processing of Acceptance of Appointment and bonds as ordered, including review of the record; generate letters of authority, issue certified letters of authority if prepaid.
• Efficiently and timely enter filings and hearing date information; effectively communicate with courtroom staff on time sensitive material.
• Create and send out WCPC correspondence letters as needed.
• Update party records in case files upon entry of related filings.
• Ensure the cohesive operation of the unit by monitoring status of work-in-progress, keeping the supervisor informed of workflow status and any pending issues due to the time sensitive nature of the work.
• Generate and process departmental quality assurance reports; review data for accuracy and follow up with pending issues.
• Assist with the verification of images and destruction of records and files.
• Facilitate the work of management by performing other duties as assigned.
